Statutes for the Non-Profit Organization University Sports Institute at the University of Klagenfurt
§ 1 Non-Profit Institute
In accordance with § 40 of the University Act 2002 (UG 2002), the University Sports Institute is established at the University of Klagenfurt. It operates as an independent organizational unit offering sports activities and competitions to students, graduates, and staff of the University, the university programmes of the Carinthian University of Applied Sciences, and the Carinthian University of Education.
The University Sports Institute operates as a non-profit entity under §§ 34 ff of the Austrian Federal Fiscal Code. The non-profit entity “University Sports Institute at the University of Klagenfurt” does not have its own legal personality. Its headquarters are located at Universitätsstraße 65-67, 9020 Klagenfurt.
§ 2 Tasks and Purposes of the Non-Profit Organization with Market-Oriented Activities
2.1 The purpose of the organization, which is not profit-driven, is to support and promote university and higher education sports at the University of Klagenfurt campus.
2.2 These tasks and purposes must be fulfilled in a planned, economical, efficient, and purpose-driven manner in accordance with §§ 34 ff of the Austrian Federal Fiscal Code.
§ 3 Means to Achieve the Non-Profit Objectives
3.1 The non-profit objectives shall be achieved through the following immaterial means:
- Organization of local and regional academic championships.
- Hosting Austrian academic championships (with international participation).
- Organizing competitions with domestic and foreign participants and involvement in matters of Austrian university sports, especially with regard to sending Austrian students or student teams to international sports events, academic world championships, and Universiades.
- Providing university sports facilities for physical activities, particularly by offering sports courses for students, graduates, and university staff, as well as for staff from university programmes at the Carinthian University of Applied Sciences and the Carinthian University of Education.
- Public relations to raise and maintain awareness of the University Sports Institute at the University of Klagenfurt among the general public.
- Organizing and conducting lectures, seminars, training courses, and other events in the fields of physical activity and health.
- Cooperation with other sports and health institutions in the region for joint resource utilization and the development of future topics.
3.2 The non-profit objectives will be achieved through the following material means:
- Resources generated from the university sports operation and the management of university sports facilities, as per § 40, paragraph 3, UG 2002.
- Grants, donations, subsidies, and other voluntary contributions.
- Revenues from events, publications, performance payments, fees, and the utilization of assets.
- Income from asset management (e.g., interest income).
- Sales revenue, such as from tickets, printed materials, or promotional items.
- Advertising measures in the interest of university and higher education sports, all exclusively within the framework of tax-exempt non-profit activities.
§ 4 Organization
4.1 According to § 40, paragraph 4, UG 2002, only a person with appropriate education and professional qualifications may be appointed as the head of the University Sports Institute.
4.2 The provisions of the UG 2002 and the statutes of the University of Klagenfurt apply.
§ 5 Financial Management and Accounting
5.1 The University Sports Institute at the University of Klagenfurt must be separately accounted for in the performance agreement and financial statement of the University of Klagenfurt, in accordance with § 40, paragraph 2, UG 2002.
5.2 The provisions of the UG 2002 and the financial management guidelines of the University of Klagenfurt apply.
§ 6 Use of Funds in the Event of Dissolution or Loss of the Beneficiary Purpose
6.1 The funds of the non-profit entity may only be used for the statutory purposes.
6.2 No individual may benefit from expenditures unrelated to the purpose of the organization or from disproportionate compensation.
6.3 In the event of the dissolution of the institute or the cessation of its beneficiary purpose, the remaining assets after covering liabilities must be used exclusively for non-profit purposes as defined in §§ 34 ff of the Austrian Federal Fiscal Code. If possible, it should be allocated to an organization pursuing similar or identical charitable purposes.
